The lawsuit challenging NYC Councilman Joseph Addabbo’s petition to run in the Democratic primary has been thrown out, according to Addabbo campaign spokeswoman Alexis Grenell.
Another Democratic rival Albert Baldeo, brought the suit aginst Addabbo, and witnesses were called in to testify on the case, according to Grenell.
Both are seeking the Democratic slot to run against Sen. Serph Maltese in the general election. In 2006, Baldeo ran as a Democrat and nearly beat the incumbent senator, losing by 800 votes.

Baldeo has said he would run as an independent candidate if he doesn’t receive the Democratic endorsement, which would help Maltese. Bruno has committed to spending upwards of $1 million to hold on to the seat, according to Maltese.
