Glenn Diresto is back on the ballot in Tuesday's special election - but his battle with candidate Geraldine Chapey is not over.
A judge ruled Tuesday that DiResto, a retired NYPD lieutenant, must be given a chance to change his party's name because the Board of Elections gave another candidate in the nonpartisan contest in the 32nd Council District the same opportunity.
The board previously ruled that DiResto's party name, Families First, violated election law because it shared a word in common with the existing Working Families Party.
Chapey is appealing the decision in the New York State Court of Appeals, her campaign said.
